Short summary experiences

Mediation clearly has its merits inasmuch as the parties stay in control of their dispute rather than relinquishing that power to an independent dispute resolver. Conciliation has the additional benefit of the conciliator’s recommendation which provides the suggested way forward to settle the parties’ differences. _x000D_As an adjudicator I have wide experience of many different types of appointments, as a dispute (adjudicator) board member under various Forms of FIDIC contracts, either as a standing board or “ad hoc” member. Sometimes these appointments are as a sole adjudicator and other times as a member or chairperson of a three-person DAB/DB. In all cases, it is important to engage with the Parties, earn their trust and respect in order to provide the quality of service needed as an effective adjudicator. Additionally, I have wide-ranging experience of serving as an adjudicator in the UK where adjudication is a statutory requirement and is intended to be completed in 28 days. _x000D_For a standing board appointment, the key requirement of an adjudicator is to assist and guide the parties in resolving their concerns and/or differences early thereby avoiding the need for them to refer matters for adjudication and other forms of dispute resolution. This dispute avoidance role can only be achieved if the parties have complete trust and respect in the adjudicator so that they recognise the value of the adjudicator’s relevant experience and opinions. _x000D_The FIDIC Conditions of Contract for Construction, together with the related MDB Harmonised Edition, provide that, with the agreement of both parties, a matter on which there is disagreement can be referred to the standing DAB/DB to give its opinion. This is a most valuable provision and in such cases the DAB/DB is acting in a similar role to that of Independent Expert. I also act as a contract expert/specialist to one of the parties in a dispute by providing an opinion on the merits of the claim. _x00
