I have acted as ICE appointed sole DB member on a €10million roads project in Moldova and have rendered 1 no. decision in respect of the Contractor’s claim for 636 days extension of time, €1.2million for Loss & Expense and refund of delay damages deducted by the Employer_x000D_I have acted as FIDIC appointed member of 2 no. 3-person DABs on a €158million rail project in Romania and have rendered 4 no. Decisions, 2 no. by each board. The Decisions by Board 1 concerned (1) alleged wrongful certification of the measured works account plus interest due at daily varying LIBOR Rates in addition and (2) alleged underpayment of VAT certified and interest payable thereon in addition. The Decisions of Board 2 concerned (1) - (a) Recovery of interest on alleged late payments and (b) the proper application of the price adjustment formula and (2) the valuation of 84 no. disputed items of the variation account._x000D_I have acted as Conciliator on one sewerage scheme dispute of value €7.75million and 3 no. roads project disputes of value €2.1million, €7.25million and €116million. The €2.1million road dispute settled on the second day of the conciliation at the level of my recommendation. The €7.25 million dispute settled 0.5% lower than my recommendation within a fortnight of making my recommendation. The €116million dispute was split into 3 tranches and gave rise to 15 no. recommendations, none of which were accepted at the time they were given. Nonetheless, the parties reached a full and final agreement within 6 weeks of the recommendations being given._x000D_I have acted as mediator of a US$4million dispute in Singapore under the FIDIC 4th edition Client/Consultant Model Services Agreement. This was a mandatory first step before arbitration. Being US$4million apart, the Parties were unable to resolve their differences on the day of the mediation._x000D_I have rendered in excess of 50 Decisions in UK construction adjudications.
