Short summary experiences

Substantial experience over more than 40 years in construction-related disputes in a variety of jurisdictions and covering the whole spectrum of building and civil engineering works. Over the last 4 years has sat exclusively as an arbitrator, adjudicator, dispute board member and mediator.Experience acting as Counsel was both domestic and international. The domestic work was largely, but not entirely, related to building disputes including two landmark decisions in the 1990s relating to extensions of time and ownership of the float under domestic JCT contracts. International experience related much more to engineering projects, including latterly representing a local subcontractor against a US prime contractor in a substantial dispute in South America relating to the construction of an LNG facility.All the arbitration experience in the UAE has been as Chair of the Arbitral Tribunal with the amount in dispute frequently substantial – one case involves 750 million dirhams. Similarly, arbitration experience in Malaysia has been as sole adjudicator or arbitrator with one recent case involving a claim of US$150 million.Standing DAB experience currently involves projects in Central America, Western Europe, Eastern Europe, Africa and the Far East. Some of these are as sole DAB member, mainly under the MDB Harmonised Contract 2010, but others are mainly under the 1999 Red Book. These include an appointment in a major infrastructure project in Central America where the standing DAB has been chaired by a retired English High Court judge. There have also been recent appointments in Eastern Europe and, unusually, in the UK under the Yellow and Silver Books 1999, one leading to a major court decision on the validity of a DAB appointment.A recent DAB appointment in the Middle East involves disputes between a designer and a main contractor in relation to a megaproject in the region.Having qualified as an adjudicator in the UK at the outset of the statutory regime adjudication
