Short summary experiences
As DAB Chairman for two major expressway construction projects in Sri Lanka, I have prepared a dispute avoidance and early dispute identification system for smooth running of project in the preliminary meeting. In my appointment of DB Sole Member for two JICA funded landslide projects in Sri Lanka, I could drive through these two projects without any dispute, using early identification of disputes and giving opinion during my site visits. When I represent the Claimant on the capacity of consultant in arbitrations, I have provided my expertise knowledge to our counsels to win the case. In my capacity as the counsel for the Claimant without legal counsels in arbitrations, I could have completed all written submissions, cross examination and reexamination as necessary. As the consultant to the Claimant in adjudication I responsible for all written submissions and oral presentations on behalf of the Claimant. When I represent the Claimant as a witness had to give evidence before arbitration tribunal. In most of cases I participated as the team leader of negotiation team of the Claimant, and then I could have explained the entitlement and the quantum of the Claimant's claims. Some instances parties asked from me the expert advice for settlement of dispute and then I will provide my expert advice considering, contractual provisions, practice and the legal basis.
